This notice describes your privacy rights under the California Consumer Privacy Act (CCPA) and how to exercise them.

Right to Know
You have the right to request that we disclose what personal information we have collected about you, the categories of sources, the business purpose for collecting it, and the third parties with whom we share it.
Right to Delete
You have the right to request deletion of personal information we have collected from you, subject to certain exceptions such as legal obligations to retain records.
Right to Opt-Out
You have the right to opt-out of the "sale" of your personal information. See our Do Not Sell section below for how to exercise this right.
Right to Correct
You have the right to request correction of inaccurate personal information we maintain about you.
Right to Non-Discrimination
We will not discriminate against you for exercising your CCPA rights. We will not deny services, charge different prices, or provide a different level of service because you exercised your privacy rights.
Right to Limit Use of Sensitive Info
You have the right to limit our use and disclosure of sensitive personal information to uses necessary to perform the services you requested.
Applicability of This Notice
This California Consumer Privacy Act (CCPA) Notice applies to California residents who interact with CapitalFunding as individuals or on behalf of businesses. It supplements our Privacy Policy and describes your rights under California law. The CCPA grants California residents specific rights regarding their personal information. As a California resident, you have the rights described in this notice, and we are required to honor those rights. This notice covers information collected in the twelve months prior to the effective date. We update this notice annually or when our data practices change materially.
Categories of Personal Information We Collect
In the past 12 months, CapitalFunding has collected the following categories of personal information from California consumers: IDENTIFIERS: Full name, email address, phone number, mailing address, IP address, device identifiers, account credentials. PERSONAL RECORDS: Business name, EIN, Social Security Number (for personal guarantees), financial account information, bank statements. COMMERCIAL INFORMATION: Business revenues, transaction history, loan application information, funding amounts, selected products. INTERNET/ELECTRONIC ACTIVITY: Website browsing history on our platform, search queries within our site, interaction with our emails and ads, clickstream data. GEOLOCATION DATA: General location derived from IP address. PROFESSIONAL/EMPLOYMENT INFORMATION: Job title, years in business, industry classification. FINANCIAL INFORMATION: Business credit scores, personal credit scores (with authorization), bank account details for funding disbursement. INFERENCES: Business risk profiles, creditworthiness assessments, product recommendations drawn from the above categories. We do not collect biometric data, health information, or precise geolocation from California consumers.
Sources of Personal Information
We collect personal information from the following sources: DIRECTLY FROM YOU: Application forms, account registration, communications with our team, support tickets, and survey responses. FROM YOUR DEVICES: Automatically collected through cookies, web beacons, and similar technologies when you use our platform. FROM THIRD PARTIES: Credit bureaus and reporting agencies (with your authorization), business credit reporting agencies such as Dun & Bradstreet and Experian Business, identity verification services, data analytics providers, public records, and lenders in our network.
Business Purposes for Collecting Information
We collect and use personal information for the following business purposes: PRIMARY PURPOSES: • To process funding applications and match applicants with appropriate lenders • To verify identity and prevent fraud • To communicate with applicants about their applications and available offers • To provide customer support SECONDARY PURPOSES: • To improve our platform, products, and services • To conduct internal research and analytics • To comply with legal obligations, including financial record-keeping requirements • To enforce our terms of service and protect our legal rights • To personalize your experience on our platform
Do Not Sell or Share My Personal Information
You have the right to opt out of the sale or sharing of your personal information. To exercise this right, you may: 1. SUBMIT A REQUEST: Email privacy@capitalfunding.com with the subject line "CCPA Opt-Out Request" and include your full name, email address, and a statement that you are a California resident requesting to opt out of the sale of your personal information. 2. USE OUR PREFERENCE CENTER: Log into your account at capitalfunding.com and navigate to Privacy Settings > Data Preferences. 3. GLOBAL PRIVACY CONTROL: Our website honors Global Privacy Control (GPC) browser signals. If your browser is configured with GPC enabled, we will treat it as an opt-out request for the associated browser session. After receiving your opt-out request, we will process it within 15 business days and provide confirmation. Note that opting out does not affect disclosures to lenders and service providers necessary to process your funding application.
How to Exercise Your Rights
To exercise your rights to know, delete, correct, or limit use of sensitive information, submit a verifiable consumer request by: EMAIL: privacy@capitalfunding.com (Subject: "CCPA Rights Request") MAIL: CapitalFunding Privacy Team, 1234 Finance Street, Suite 500, New York, NY 10001 PHONE: +1 (718) 695-0836 (say "CCPA request" when connected) YOUR REQUEST MUST INCLUDE: • Your full name and email address used to create your account • The specific right(s) you wish to exercise • For deletion requests: whether you want all information deleted or only specific categories VERIFICATION: We are required to verify your identity before processing CCPA requests. We will verify identity by matching information you provide against our records. We may ask for additional information if needed. AUTHORIZED AGENTS: You may designate an authorized agent to submit CCPA requests on your behalf. We require written authorization from you and may verify directly with you before processing the request. RESPONSE TIME: We will respond to verifiable requests within 45 days. If we need additional time, we will notify you and may extend the response period by an additional 45 days.
Financial Information Exemptions
Please note that certain personal information we collect may be subject to exemptions under the CCPA. GLBA EXEMPTION: Personal information collected and processed in connection with financial products and services governed by the Gramm-Leach-Bliley Act (GLBA) is exempt from certain CCPA provisions. This may include information we share with lenders in our network for the purpose of processing your loan application. FCRA EXEMPTION: Personal information regulated by the Fair Credit Reporting Act (FCRA), such as credit report information obtained from consumer reporting agencies, may also be exempt from certain CCPA provisions. Even for information that falls within these exemptions, we are committed to protecting your privacy and will handle such information in accordance with applicable federal law and our Privacy Policy. Your rights under the CCPA remain fully applicable to personal information that is not subject to these exemptions.
California Shine the Light
California Civil Code Section 1798.83 (the "Shine the Light" law) permits California residents to request certain information about our disclosure of personal information to third parties for those parties' direct marketing purposes. To make such a request, please contact us at privacy@capitalfunding.com with "Shine the Light Request" in the subject line. Include your name, mailing address, email address, and phone number. We will respond within 30 days. CapitalFunding does not share personal information with third parties for their direct marketing purposes without your consent.
